A police officer is to be charged with raping a female suspect as she was being held at a police station.

Constable Ibrahim Njogu Kamau, who is still at large, is to face two charges, a court was told Thursday.

Corporal Margaret Muthui, who is investigating the case, told Tigania Resident Magistrate Paul Wechuli that they have concluded investigations and established that the suspect was raped.

“We have concluded investigations and we have drafted the charge sheet. We have preferred rape and indecent acts charges against him,” Corporal Muthui told the court.

Ms Muthui was tabling a report in court after criminal investigations officers were directed to look into the case following an application by lawyer Kennedy Nyamokeri who accused police officers at Mulika station of spiking a packet of milk before serving and raping her client.

Constable Kamau, who is based at Mulika Police Station in Tigania Central, has not reported at the station for the last two weeks, the court heard.

A female suspect had told Mr Wechuli that policemen spiked the milk they served her before raping her. She said she woke up in the morning and realized she had been abused.

The suspect had been locked up at the station for malicious damage and later released on police bail pending appearance in court.

However, she was re-arrested and locked up in separate cell despite paying Sh30,000 police cash bail.

She was accused of destroying a mattress, assorted clothes and three plastic containers worth Sh70, 000 belonging to her husband, who reported the matter to police.

However, on Thursday the court directed that the file be forwarded to the assistant director of public prosecution Evans Onderi for evaluation before charging the police officer.

Prosecution counsel Keyne Odhiambo had asked the magistrate to grant the prosecution time to check the file before issuing a warrant of arrest against the officer. The matter will be mentioned on Monday, next week.
