Babu Owino alias Paul Ongili has lost his seat as Embakassi Member of Parliament after the High Court in Nairobi nullified his election .
In his ruling Justice Joseph Sergon ordered a by-election and IEBC with Babu Owino to pay each 2.5 million to petitioner Francis Mureithi who was his closest rival
Mureithi had claimed that the election was punctuated with , intimidation, voter bribery among other electoral malpractices.
Which had prompted the court to order a repeat count of the votes.
Mureithi and Owino registered an increase after the counting but Babu Owino still recorded the highest count of the votes
The deputy registrar submitted that the scrutiny and recount exercise was by and large a success, except for a regrettable incident where one of the deputy registrar’s phone was stolen.
