On Friday 14th December 2018, Justice Chacha Mwita made a landmark ruling on Miguna Miguna’s citizenship case when he ordered that Miguna Miguna’s birthright was not affected by him holding a Canadian passport and said his rights were violated when the State deported him earlier in 2018.

Justice Chacha Mwita has restated what I've maintained throughout: That the despots violated my fundamental rights, freedom and dignity and that I'm a Kenyan and never lost my citizenship. Thanks Dr. Khaminwa, @waikwawanyoike, @kamandamucheke, @NelsonHavi and other lawyers.

Miguna Miguna was aso won sh.7 million after court awarded him due to the fact that his rights were violated adding that his citizenship by birth could not be revoked.

“Even if the petitioner (Miguna) acquired Canadian citizenship, he did not lose his Kenya citizenship. He remains a citizen of Kenya, said Justice Chacha

To deter such ‘overzealous’ actions from state officers in future, 
Interior CS Fred Matiang’i and Immigration PS Gordon Kihalangwa were ordered to pay the money personally 

“Damages cannot be borne by taxpayers. They are borne by the respondents jointly and severally to dissuade future violations,” Mwita ruled

Damages of 7 million and 270,000 awarded to @MigunaMiguna. Court says tax payers should not shoulder costs of violations by overzealous state officers. In order to deter future violations Respondents @FredMatiangi And @GKihalangwa to personally pay damages and costs.

The High Court has ruled that the Government violated Miguna Miguna's rights and he never lost his Citizenship by acquiring Canadian Citizenship. The government has been Ordered to pay him 7 million in damages since he is still in Canada. A Big win for the General. Viva!
