Jowie Irungu, also known as Joseph Irungu, has taken a significant legal step in his ongoing case by filing a notice of appeal against the death sentence handed down by the High Court. The appeal, filed through his new legal representative Andrew Muge, challenges both the conviction and the severe sentence pronounced by Lady Justice Grace Nzioka.
Jowie Appeals court decision
The court document obtained by Kenyans.co.ke reveals Jowie’s readiness to participate in the appeal hearing. This move comes after Jowie had previously engaged Hassan Nandwa as his defense counsel.
The notice of appeal states, “Take notice that Joseph Kuria appeals to the Court of Appeal against the decisions of the Honourable Lady Justice Grace Nzioka delivered in open court at Milimani, Nairobi on February 9, 2024, and in her written judgment dated February 9, 2024, whereby the Appellant was convicted of Murder and sentenced to death on March 13, 2024.” It is clear that Jowie is challenging both the conviction for murder and the subsequent death sentence.
The case revolves around the tragic murder of businesswoman Monica Kimani back in September 2018, for which Jowie was found guilty. Justice Nzioka, in her sentencing, imposed the maximum penalty of death for the murder charge, citing the prosecution’s compelling evidence and Jowie’s character as contributing factors.
Following the sentencing, Jowie’s legal team expressed respect for the court’s decision while signaling their disagreement. They stated, “This unfortunate decision, as much as we disagree with the learned judge, there is a way out. We will appeal and we’re hopeful that our appeal will be allowed when it comes.” The lawyer also affirmed their intent to proceed to the Court of Appeal at the appropriate time.
This development marks a crucial phase in Jowie Irungu’s legal battle, as he seeks to challenge the conviction and the severe penalty imposed by the High Court.
