Judith Wandera was sentenced to 15 years in prison after being convicted of defiling a minor aged 16 years old.

The 24 year old woman shocked the court after she admitted having done incident act with the underage boy.

Principal Magistrate Ms Joan Wambilyanga of the court in Kisumu city found the defendant guilty of defilement and intentionally performing indecent act on a minor contrary to the Sexual Offences Act, on July 5, 2017 at Kicomi area.

From the court evidence presented, the two were ruled to have been performing sex related acts since they knew each other.

The two were been arrested one year later on July 17th, in 2017,

“Both admitted to having sex, sometimes protected, sometimes unprotected. According to her, she could not tell how many times they did it,” said Ms Wambilyanga.

Ms. Wandera noted that she could not establish whether the boy was a minor from the looks, which the court gave in but found her ignorant of proceeding to find out more about his age.

The accused also claimed that he was a boda boda rider who had abused drugs, with dreadlocks making it difficult to identify his age.

“There was no evidence the complainant lied about his age and the accused’s defence was disregarded based on her failure to prove what steps she took to establish whether the boy was under age,” said Ms Wambilyanga.

The two had been arrested twice and the woman warned of the age difference.

In mitigation, the accused asked for forgiveness stating that she had a kid, brother and sister to take care of.

“I am the only person taking care of all of them. Please forgive me I will never repeat the offence again,” she pleaded.

It fell on deaf ears as she was slapped with 15 years behind bars
